I know the sentence. It is what a department says when a law passed in 1990 tells it to hold a lottery every year for up to fifty-five thousand green cards, and it announces “changes,” promises dates “as soon as practicable,” lets eleven months go by without opening the door, and then walks into federal court to explain, with a straight face, that the door has been closed so long it would be unreasonable to open it now.

On Wednesday, October 14, 2026, U.S. District Judge Jinsook Ohta of the Southern District of California granted a preliminary injunction in Red Eagle Law, L.C. v. Rubio, No. 26-cv-4738, ordering Secretary of State Marco Rubio and the State Department to revive the fiscal year 2027 Diversity Visa Program — the Green Card Lottery. Her two-page order told the department to publicly announce the registration period on travel.state.gov no later than midnight EST on October 15, with opening and closing dates, the entry website, and the rules, and to push it through its “other customary public notification channels, including the Federal Register”; to open registration by midnight EST October 18 and keep it open for thirty days; to notify selectees by November 19; and to process their applications “in accordance with its usual procedures and standards” until the fiscal 2027 allocation is exhausted or September 30, 2027, whichever comes first. Courthouse News Service’s Quinn Welsch reported that the administration, which has opposed the program, “did not open the program’s registration period on time for this year and subsequently argued that it was too late to do so.” Factum Immigration laid out the timeline: registration would normally have run in fall 2025; instead, on November 5, 2025, State said it was implementing changes to the entry process and would announce dates as soon as practicable. Bloomberg Law’s Alex Clearfield reported that the administration then suspended the program last December, after a Portuguese national who had received a visa through it was suspected in two deadly shootings in Rhode Island and Massachusetts, and in March issued a rule requiring applicants to hold a passport; Factum adds that the new rules set a $1 electronic registration fee and require an uploaded passport-page image. Red Eagle Law, a Southern California immigration firm that helps people apply, sued Rubio in August; Ohta had earlier denied it a temporary restraining order. Founder Curtis Morrison argued the failure to reopen was a de facto cancellation and told Courthouse News that the ruling means “the Trump administration can’t just ignore the laws they don’t like.” Bloomberg Law noted that last month a Northern District of California judge found the department had restarted fiscal 2026 processing at “an unprecedented glacial pace.” The State Department said it wouldn’t comment on pending litigation; the Justice Department did not respond to Courthouse News. And the clock moved again within hours: Morrison says both sides jointly asked Ohta for two more weeks and that she agreed, and the Times of India reports a revised schedule — announcement by October 29, entries open by November 1, selectees by December 3. Factum cautions that the amended written order had not been independently verified, and I have not seen it either. As of this afternoon, the deadline in the order I can read was midnight tonight.

Tyrone timed the docket against the State Department’s “as soon as practicable” and gave up at eleven months. Deb filed “too late” under “things you say after you hid the car keys.” Taryn asked whether a lottery you never hold still counts as a lottery. I love them. They are seasoning.

Too late is the alibi. The calendar is the story. Sit with the eleven months until they confess. A government that cannot get a repeal through Congress has discovered it does not need one: it can announce “changes,” suspend, add a fee and a passport upload, slow-walk the year before at a pace another judge called unprecedentedly glacial, and then tell the court the season is over. That is not administration. That is a veto by stopwatch. I am not crowning the court, either — it is the same stamp in a different building, the one that said no to a restraining order before it said yes to an injunction, and it now has to babysit a department through a website announcement like a substitute teacher. I am not crowning the law firm; Red Eagle sells help with this exact lottery, and its interest and the applicants’ interest happen to point the same way this week. The people with no lawyer in the case are the ones who were told to wait for a date that was never meant to come. Both parties are the help, and the help has learned that a deadline can do quietly what a vote would have to do in public. The cardigan stays. Fill the notebook. Then ask, out loud, whose lottery it is when the state decides the odds by deciding when the drawing never happens.

Sources: Courthouse News Service, Quinn Welsch, “Trump admin ordered to reinstate 2027 Green Card Lottery,” Oct. 14, 2026; U.S. District Court, S.D.
