I know the sentence. It is the one a company writes after the emergency is over and before the lawyers are done, when the plume has thinned out and the press release has thickened up. It is a beautiful phrase. It promises nothing and sounds like a hug. I have written that sentence for other people, back at the You Know Who Post, in the voice of somebody who would rather you didn’t call. The trick is the word “all.” All claims will be given serious consideration. Nobody said paid.

Here is the record. Spectrum News 1’s Madison MacArthur reported Oct. 28, 2026, that residents and businesses have filed a proposed class action against M.C. Tank Transport, Inc. and its parent company, The Kenan Advantage Group, Inc., over the release of glycidyl methacrylate, or GMA, from a compromised tank container at the company’s terminal on Progress Avenue in Toledo, Ohio. According to the lawsuit, the release began at about 9:30 p.m. on Oct. 20 and lasted more than 45 hours, leading to a one-mile evacuation order affecting about 1,000 residents and a three-mile shelter-in-place order the complaint says affected more than 50,000 people. Spectrum notes the International Agency for Research on Cancer classifies GMA as a probable human carcinogen that can cause severe irritation of the skin, eyes and respiratory tract. The complaint alleges 57 people were treated at area hospitals, and that the plume reached beyond the official zones, with Ottawa River Elementary students sent home early after reporting headaches and odors. Lead plaintiff Heather Keyes alleges she got no warning from the defendants or officials and that the plume entered her home; she and her 13-year-old son, who has asthma, had raspy throats and headaches. Another plaintiff with COPD says she was forced to evacuate and hospitalized with pneumonia. The suit seeks damages, punitive damages and a medical monitoring program paid for by the defendants. As for how it happened: WTOL’s Andrew Bailey and Heidi Gasser reported Oct. 23 that, according to officials, an employee of MC Tank Transport “introduced a temperature level to the tank in the process of trying to transfer a liquid,” which set off the chemical reaction, and that the mayor said the company has accepted responsibility. The EPA’s on-scene coordinator said the reaction lasted about 30 hours. ProMedica’s Dr. Brian Kaminski said the hospital system treated about 60 patients, almost all released.

Now the defense, and the company has written it out. MC Tank’s statement of Oct. 27 says it “remains committed to supporting our Toledo neighbors,” that “Toledo is home to hundreds of our employees and their families,” and: “We sincerely apologize for the worry and hardship this has caused.” It has set up a claims line at 888-271-0577, and says, “All claims will be given serious consideration and review.” It hired three environmental and hazmat firms that were on site within 24 hours, and it quotes the U.S. EPA’s Oct. 27 update: “Air monitoring and sampling data have not shown detections of glycidyl methacrylate or other hazardous chemicals above screening levels.” Fine. I believe the air is clearing, and I believe the company is sorry, in the specific way a company is sorry. But read the apology again. It apologizes for the worry. Not for the heat, not for the tank, not for the 13-year-old with asthma — for the worry, as though the problem were the neighborhood’s feelings about a carcinogen rather than the carcinogen. Accepting responsibility at a press conference is free. Responsibility with a dollar sign on it is now a claims line staffed by people whose job is to consider. And note who wrote the most important sentence in that statement: the company is quoting a federal agency’s screening levels as its character witness. The firm made the mess, the government measured it, and the firm pinned the measurement to its own lapel. The mayor, for his part, told reporters “it’s the dosage that makes the poison,” which is true in a toxicology lecture and less comforting in a kitchen.

Taryn says the twins would have been inside that three-mile ring if we lived in Toledo, and she’s now pricing air purifiers like they’re strollers. Cricket wants to laminate the claims number and put it on the fridge just in case, which, in this family, means it’s already done. I love them. They are seasoning.

“Serious consideration” is the alibi. The heated tank is the story. Sit with it until it confesses. A company moved a probable human carcinogen through a terminal in a city, a worker, officials say, introduced a temperature level to the tank during a transfer, the neighborhood breathed it, and the cure on offer is a phone number and the promise that someone will think about it, seriously, under review. The anti-capitalist in me never left; the libertarian in me agrees with him on this one: if you own the tank, you own the plume, and nobody should have to file a claim to be made whole for air they didn’t buy. The cardigan stays. Fill the notebook. Then call that line, out loud, and ask: what does serious consideration pay, who decides, and how long does a claim stay “under review” before somebody calls it closed?

Sources:

Spectrum News 1, Madison MacArthur, “Toledo residents, businesses file lawsuit following chemical release,” Oct. 28, 2026

WTOL 11, Andrew Bailey and Heidi Gasser, “Preliminary air quality results released; Emergency portion of Toledo chemical leak ends.
