I walked out of the poetry reading with wine on my breath and someone else’s metaphor in my throat — envelopes as little republics — and my phone was buzzing: Judge Indira Talwani just handed the midterms a preliminary injunction that actually means something.
Friday, Sept. 4: Talwani barred USPS from enforcing the mandatory guts of its new Ballot Mail for Federal Elections rule — envelope redesigns, portal choke points, Trump-era mailbox-as-velvet-rope. Democracy Docket, L.A. Times, Law Dork, and Reuters agree: it sprang from a March executive order; USPS finalized it in late August; Talwani’s Aug. 27 TRO became Friday’s sturdier injunction for the Nov. 3, 2026 midterms. She held the executive has no inherent authority to rewrite state election rules, and Congress never handed USPS the ballot box. California, Democratic-led states, and the League of Women Voters got the shield.
North Carolina had already started mailing ballots that day. The election has begun. The administration is already clawing toward the Supreme Court for a stay.
I cried on the curb outside the bookstore. A ballot is a poem they keep trying to censor. The rule wanted verification gauntlets that would stress-test nursing-home voters and rural mailboxes. Talwani said no — for this cycle — loud enough that DOJ has to beg again.
Buck will text that this is “judicial activism.” Deb will reply-all that we are not arguing politics after 9 p.m., then do it anyway. I love them. I also love that a federal judge told USPS it cannot cosplay as a legislature.
